What is ILOE?


The Federal Decree Law No. 13 of 2022 of United Arab Emirates introduces a program called the Involuntary Loss of Employment (ILOE) Scheme, which aims to provide financial support to employees who lose their jobs for reasons other than misconduct or quitting. This scheme is designed to help them until they can secure a new job.

Under this program, eligible employees will receive a monthly cash payment, which can be up to 60% of the average basic salary they earned in the six months leading up to their job loss. This cash benefit will be given for a maximum of three consecutive months. However, it's important to note that this benefit is only available to workers who have consistently paid the monthly premium for at least 12 months in a row.

In simple terms, you can get a monthly payment for a certain period after losing your job, and the amount depends on your salary and category. However, there is a limit to how much you can receive over your entire career in the UAE.

Here's a brief summary of the two categories for the ILOE plans:

Category A :

 

  • Basic Salary: If your basic salary is 16,000 AED or below.
  • Maximum Monthly Claim: You can claim a maximum of 10,000 AED per month if you experience
    involuntary job loss.
  • Duration: You can receive this benefit for a maximum of three consecutive months.
  • Lifetime Limit: The total compensation you can receive over your entire career in the UAE is capped
    at 12 monthly benefits, regardless of the number of claims.

 

Category B:

 

  • Basic Salary: If your basic salary is above 16,000 AED.
  • Maximum Monthly Claim: You can claim a higher amount, up to 20,000 AED per month, in case ofinvoluntary job loss.
    Duration: Similar to Category A, you can receive this benefit for a maximum of three consecutive months.
  • Lifetime Limit: Just like Category A, the total compensation you can receive over your entire career in the UAE is limited to 12 monthly benefits, regardless of how many claims you make.

 

In essence, these categories distinguish between individuals with lower and higher basic salaries, providing different compensation limits while still ensuring a lifetime limit to manage the overall benefits received.

 

Premium Payment
Here;s a simplified explanation of the premium and payment options for the Involuntary Loss of Employment (ILOE) plans:

Premiums:
Category A Employees: If your basic salary is 16,000 AED or below, you pay 5 AED per month for the insurance premium.

Category B Employees: If your basic salary is above 16,000 AED, you pay a slightly higher
premium of 10 AED per month.

VAT: When you start the policy, the full VAT amount is added to your first payment.

Policy Period:
You can choose between two policy periods: either 1 year or 2 years.

Premium Payments:
You have four options for how often you pay your premiums:

 

  • Monthly: Paying every month.
  • Quarterly: Paying every three months (once every quarter).
  • Semi-Annually: Paying every six months.
  • Annually: Paying once a year.

Note: It;s important to remember that the premiums you pay are non-refundable. This means that once you;ve paid, you won;t get your money back, regardless of whether you make a claim or not. So, its essential to choose your payment frequency and policy period carefully based on your needs.

Important dates and deadlines

As per the Ministry of Human Resources and Emiratisation (MoHRE), UAE nationals and residents have been given an extended deadline until October 1, 2023, to sign up for the Involuntary Loss of
Employment (ILOE) insurance scheme to avoid fines.

The ILOE scheme became effective on January 1, 2023, with an initial grace period of six months that was originally set to end on June 30, 2023. However, this grace period has been extended to October
1, 2023.

If you fail to enrol in the ILOE scheme by the extended deadline of October 1, you will be subject to fines as outlined in Cabinet Resolution No. 97 of 2022:

  1. A fine of Dhs400 imposed by the Ministry for not subscribing to the UAE unemployment insurance.
  2. An additional fine of Dhs200 if you fail to pay the required insurance premiums for more than three months.


So, its important to enrol in the ILOE scheme before the specified deadline to avoid these fines and ensure that you have the necessary employment insurance coverage.

Who can buy these plans?

Eligibility for unemployment insurance includes:

  • Emiratis: Citizens of the United Arab Emirates (UAE).
  • Residents: Non-citizen residents who work in both the private and government sectors.

However, there are certain categories of individuals who are not eligible for unemployment insurance. These include:

  • Business Owners: Individuals who own and manage their own businesses are not eligible. This typically refers to entrepreneurs and those who are self-employed.
  • Investors: People who have investments but are not actively employed by a company are no eligible for unemployment insurance.
  •  Household Workers: Individuals working in private households as domestic helpers or similar roles are not covered by this insurance.
  • Temporary Employees: Those employed on a temporary or short-term basis may not be eligible. The insurance is generally for regular, long-term employees.
  • Minors: Individuals under the age of 18 are not eligible for unemployment insurance.
  • Retired Individuals with Pensions: If someone is retired and receives a pension, they are not covered by this insurance since they are no longer actively employed. Its important to note that eligibility criteria may vary, and individuals should check with their respective authorities or employers for specific details regarding their eligibility for unemployment insurance.

 

How to Request Compensation:

  • If you;ve lost your job, here's how you can claim compensation:
  • You have 30 days from the day you became unemployed to submit your claim.
  • You'll receive your compensation from the insurance within two weeks.
  • You"ll be paid for up to three months, or until you find a new job, whichever comes first.

To be eligible for compensation, you must:

  • Have paid the insurance subscription for 12 consecutive months.
  • Be legally present in the UAE.
  • You won't receive compensation if:
  • You were fired due to disciplinary reasons under UAE Labor Law (Federal Decree-Law No. 33 of 2021), federal government Human Resources Law, or any applicable laws.
  • You resigned voluntarily.
  • The claim involves fraud or deception.
  • The company where you worked doesnt exist.
